Determining Income for Spousal Support Payments

Negotiating spousal support is one of the most complex and contentious areas of family law. Once in place, a court order and written agreement for spousal support are legally binding.

At Soby Boyden Lenz, we are backed by years of legal knowledge and practice in Calgary, Alberta. Our goal is to negotiate a favourable outcome — one that provides sufficiently for the recipient, but is financially sustainable for the payor.

Ensuring Full and Detailed Disclosure

In order to calculate an appropriate spousal support structure, both parties need to clearly understand each other's financial situation.

Some income sources, assets and financial resources are not readily discernible or may be tricky to assess. Knowing what is at stake for our clients, our lawyers work with skill and thoroughness to gain as accurate a picture of a person's income sources, including:

  • Employment income
  • Self-employment income
  • Business or corporate income
  • Non-taxable income sources
  • Income from social assistance, where applicable
  • Governmental tax credits or benefits
  • Fluctuating investment income
  • Indications of hidden assets

After analyzing the composite financial picture, we can work at calculating an amount, duration and type of payment structure that works best for our client. Once a spousal support agreement is reached, it should be reflected in a written agreement and/or Court order to ensure it is enforceable.
